GENERAL CONDITIONS
OF SALE

Preamble

These General Conditions govern the relationship between Gallia.aero and its customers for catering services.

Orders

A proposal is presented to the client. The sending of the offer does not take the place of
reservation. The order becomes effective after receipt of the offer signed by the customer or confirmed by return email. Acceptance of the order constitutes acceptance of the general terms and conditions of sale (GTC), available on the website www.gallia.aero.
A confirmation is then sent to the customer.

It stipulates:

• The choice of the menu
• The nature of the service
• The number of passengers
• The date of the event
• Place and time of delivery.

Delivery

The delivery costs also include the return of the material. The price is determined and accepted under quotation.

For reasons of security and quality of service, Gallia.aero endeavors to deliver the products to the customer in person. If the customer is not present during the delivery and without indication to the contrary on his part, the products are deposited at the airport assistance service of his choice. The customer can also indicate the address and telephone number of the reception of a company when ordering.
Gallia.aero undertakes to respect the cold chain until the delivery of the products to the customer’s address by all appropriate technical means. From this moment, the responsibility rests solely with the customer, independently of his presence during the delivery. It is up to the customer to recover his products within a reasonable time to maintain the cold chain. The customer assumes responsibility for the products once delivered, even if they are dropped off at the airport assistance service or at the reception of a company in his absence. Gallia.aero declines all responsibility in the event of theft of the delivered order, break in the cold chain, or deliberate damage to the package. However, in the event of a problem with an order placed in his absence, the customer is invited to contact Gallia.aero to find possible solutions with the aim of customer satisfaction.

Product Informations

Upon delivery, the customer will ensure compliance with the storage conditions. The meals are delivered fresh daily in reusable insulated coolers belonging to Gallia.aero. They must be consumed on the day of delivery and within 2 hours of leaving their packaging and/or opening the trays.
Gallia.aero asks its customers not to freeze its products. The customer is solely responsible for maintaining the cold chain. Gallia.aero cannot guarantee a total absence of allergenic products in its menus. Gallia.aero would not be held responsible for this fact.
For any information on this subject, the customer is encouraged to contact Gallia.aero by phone at 078.837.98.02 or by e-mail at contact@gallia.aero from Monday to Friday from 9 a.m. to 3 p.m.

Incomplete Delivery

If a product from our Gallia.aero menus is not available at the time of delivery, Gallia.aero will endeavor to inform the customer as soon as possible. The product(s) will not be invoiced or sent later, and the customer cannot make any claim in this regard. If an invoiced product cannot be delivered, the corresponding amount is refunded to the customer. There is no new delivery, and the customer cannot claim damages.

Warranty and Liability

Gallia.aero cannot be held liable for any damage that may result from the use of the Internet network, such as loss of data, intrusion, virus, suspension of service, fraudulent use of credit card. Moreover, Gallia.aero cannot be held liable for any direct or indirect damage caused by the customer’s fault, but not only non-compliance with storage or preparation conditions.

Payement Terms

Payment of the invoice at 30 days net after receipt of the invoice. Otherwise, Gallia.aero reserves the right to send a reminder fee of CHF 30 after the first reminder.

Cancelation

Cancellation of the contract after acceptance of the quote is only possible in the event of force majeure, in particular death or serious illness.

In the event of accepted cancellation, damages are however due to the following conditions:

• 50% of the expected billing between 24 hours and 48 hours before delivery
• 100% of the expected billing less than 24 hours before delivery

Material

Lost or damaged equipment will be invoiced at the purchase price, this also concerns delivery equipment not returned and delivery cooler bags.

Gluten Free

For any order of gluten-free dishes, we disclaim all responsibility in the event of a problem. Indeed, our kitchen receives all types of products with and without gluten, which is why we cannot fully guarantee gluten-free products in a kitchen that contains them.

Allergens

Some dishes we prepare in our kitchen may contain these allergens. In case of allergy or intolerance, please contact our staff who will gladly inform you.

Major Force

Gallia.aero may release itself from its obligations or suspend performance if it finds itself unable to assume them following a case of force majeure (war, riot, demonstrations, exceptional climatic conditions, disaster affecting facilities of its establishments, etc.), without this giving rise to any compensation in favor of the customer.

Intellectual Property

The texts, photographs, images, underlying technology and logos appearing on the Gallia.aero site is the exclusive property of Gallia.aero or its suppliers and are protected by intellectual property rights. Any use or reproduction, even partial, in any manner whatsoever by the customer of any of the elements listed below is strictly prohibited, except with the prior and express consent of Gallia.aero. The photographs are non-contractual; Gallia.aero is therefore not responsible for any differences that may exist between the photographs and the Gallia.aero products.

Applicable Right

Swiss law applies to the contracts concluded between Gallia.aero and its customers as well as to the present General Conditions of Sale which govern them.

Legal Venue

In the event of a dispute, Gallia.aero and the customer will endeavor to settle it amicably. If no amicable agreement could be found, any dispute resulting from the interpretation or execution of the contract subject to these General Conditions of Sale will be the exclusive jurisdiction of the courts of the Canton of Geneva, subject to recourse to the Court. federal. Any other imperative forum resulting from the law is also reserved.
